# 158 Documents: What the DOJ Epstein Files Say About Alan Dershowitz

Alan Dershowitz appears in 158 DOJ Epstein documents. Not as a witness. Not as a bystander. As a participant — Epstein's defense attorney who intimidated victims, lobbied prosecutors, and wrote a 1997 op-ed arguing the age of consent should be lowered to 14.

The Victim Intimidation Letter (EFTA01333242)



Dershowitz wrote a letter to Detective Joseph Recarey of the Palm Beach Police Department — the lead detective on the Epstein case. The letter's purpose: discredit a victim.


He sent private investigators to a teenage victim's home in Jacksonville, Florida at 6:30pm. When they arrived and identified themselves as "investigators from Miami working on behalf of Jeffrey Epstein," the victim's response was immediate:


> "I don't talk to fucking cops and I'm not talking to you. Get the fuck off my property."


Dershowitz's letter then characterizes her as a "drama student" with a "fascination with marijuana" who wanted to be "really, really rich."


**ELI5:** Epstein's lawyer sent men to a teenager's house at night, she told them to leave, and then he wrote the detective a letter calling her a pothead who was lying for money. That's witness intimidation dressed in Harvard letterhead.


The "Nice Having a Drink" Emails (EFTA00013834, EFTA00013605)



These are email exchanges between Dershowitz and a U.S. Attorney's Office official. The subject line tells the story: "It was nice having a drink."


Dershowitz writes:


> "It was so nice having a relaxed drink and conversation on the porch of our neighborhood bistro."


Then gets to the point:


> "I especially appreciate your assurance that the feds will not interfere with how the Palm Beach sheriff administers Jeffrey's sentence as long as he is treated like any similarly situated inmate."


The USAO official's response is careful but damning:


> "The United States Attorney's Office will not interfere with how the Palm Beach Sheriff's Office administers the sentence imposed by the Court. That being said, this does not mean that the USAO condones or encourages PBSO to mitigate the terms and conditions of his sentence."


In a follow-up email (EFTA00013605), Dershowitz writes:


> "I greatly appreciate your willingness to call the sheriff and advise him that your office would take no position on how he handled Epstein's sentence."


**ELI5:** Dershowitz had drinks with a federal prosecutor on a porch, got a verbal promise they wouldn't fight Epstein's work-release deal, then emailed to confirm it in writing. That's how a child sex trafficker got to leave jail 12 hours a day, 6 days a week.


The Federal Lawsuit (EFTA00027034-00027039)



Case 1:19-cv-03377-LAP, Southern District of New York. A victim sued Dershowitz directly. Multiple court filings in the index show motions, amended complaints, and declarations. This wasn't a rumor or an allegation in someone else's case — this was a victim taking Dershowitz to federal court.


The 1997 Op-Ed: "Statutory Rape Is an Outdated Concept"



On May 7, 1997, Dershowitz published an opinion column in the Los Angeles Times arguing that statutory rape laws were outdated and that the age of consent should be lowered — to 15, or perhaps even 14.


When this resurfaced in 2019, Dershowitz defended it on X/Twitter: "I stand by the constitutional (not moral) argument I offered in my controversial oped."
