# The Butterfly Effect: How Epstein Created a Secret Trust to Pay His Co-Conspirators


**The EFTA documents reveal a legal mechanism designed to funnel money to the women who helped run his trafficking operation**

The Discovery



While indexing 109,427 documents from the DOJ's Epstein Task Force Archive, we found something that has received almost no media attention: **EFTA01282018 through EFTA01282040** - the complete documentation of the "BUTTERFLY TRUST."


This irrevocable trust, dated **December 27, 2006**, named exactly three beneficiaries:


1. **SARAH L. KELLEN** - Epstein's scheduler and recruiter

2. **NADIA MARCINKOVA** - Epstein's "sex slave" who became a procurer

3. **GHISLAINE N. MAXWELL** - The alleged madam, now serving 20 years


These are the three women most central to Epstein's trafficking operation. And Epstein created a legal mechanism to pay them.


The Timing



The Butterfly Trust was created on **December 27, 2006**.


What else was happening in December 2006?


- The FBI had been investigating Epstein since 2006

- The U.S. Attorney's Office was already in discussions with Epstein's defense team

- Negotiations for what would become the Non-Prosecution Agreement (NPA) were underway


From **EFTA00010507-EFTA00010520**, the court documents show:


> "From January of 2007 through September of 2007, discussions took place between the U.S. Attorney's Office for the Southern District of Florida and Jeffrey Epstein's attorneys."


The Butterfly Trust was created **while Epstein was negotiating his immunity deal**.


What the Trust Document Says



From **EFTA01282020** (emphasis added):


> "The Trustees, in their **complete and uncontrolled discretion** are authorized to distribute **any part or all of the income or principal of the Trust** (either outright or in further trust, upon such terms and conditions as the Trustees shall determine in their **sole and absolute discretion**) to any one or more persons then living from a class consisting of **SARAH L. KELLEN, NADIA MARCINKOVA and GHISLAINE N. MAXWELL** in such amounts and proportions and to the exclusion of any one or more of them as the Trustees may determine."


Key provisions:


- **Irrevocable**: Cannot be changed or terminated (EFTA01282022)

- **No accountability**: "The Trustees shall not be accountable to any Court or any person regarding the exercise or nonexercise of this completely discretionary authority"

- **Offshore jurisdiction**: Governed by US Virgin Islands law

- **21-year perpetuity**: Trust terminates "twenty-one years after the death of the last survivor of the Grantor, SARAH L. KELLEN, NADIA MARCINKOVA and GHISLAINE N. MAXWELL"


The trustees? **Darren K. Indyke** and **Richard Kahn** - Epstein's personal lawyers.


The NPA Connection



The Non-Prosecution Agreement signed on **September 24, 2007** contained this language (EFTA00010513):


> "The United States also agrees that it will not institute any criminal charges against **any potential co-conspirator** of Epstein, including but not limited to [names redacted]."


The NPA granted blanket immunity to co-conspirators. The Butterfly Trust ensured those co-conspirators would be financially rewarded.

The trust was created as a failsafe. Even if Epstein went to prison, his co-conspirators would be taken care of.


Epstein Added More Beneficiaries



The documents show Epstein kept expanding the trust. From **EFTA01282039** (March 28, 2011):


> "DARREN K. INDYKE and RICHARD KAHN are the current acting trustees of the Trust and desire to add each of **Jennifer Kalin** and **Alina Boiko** as a beneficiary under Article Third of the Trust Agreement"


From **EFTA01282040** (March 24, 2011):


> "DARREN K. INDYKE and RICHARD KAHN... do hereby add **Susan Hamblin** as a beneficiary under Article Third of the Trust Agreement."


Who are these women? The trust doesn't say. But the pattern is clear: Epstein used the Butterfly Trust to financially reward women who served his operation.


The Shell Company Network



The Butterfly Trust wasn't the only financial mechanism. The same trustees - Indyke and Kahn - appear across Epstein's corporate network:


**Southern Trust Company, Inc.** (EFTA01297567):

- Board of Directors: Jeffrey Epstein, Darren K. Indyke, Richard Kahn

- Location: US Virgin Islands

- Connected to: Financial Trust Company, Inc.


**Financial Trust Company, Inc.**:

- Same board: Epstein, Indyke, Kahn

- Merged into Southern Financial, LLC in 2013

- This is the same "Financial Trust Company Inc" that appears in Leon Black's Environmental Solutions Worldwide SEC filings (see our previous reporting)


**Financial Infomatics, Inc.** (EFTA01297570):

- Officers: Jeffrey Epstein (President), Darren Indyke (VP/Secretary), Richard Kahn (Treasurer)

- Created: November 18, 2011


The same two lawyers managed everything: the trusts, the shell companies, the money flows.


Why This Matters



The Butterfly Trust reveals something important about how Epstein's operation worked:


1. **Anticipation of prosecution**: The trust was created while federal investigation was active

2. **Co-conspirator rewards**: Named beneficiaries were the women most involved in trafficking

3. **Legal insulation**: Irrevocable, unaccountable, offshore jurisdiction

4. **Lawyer involvement**: Epstein's own attorneys served as trustees with "complete and uncontrolled discretion"


This wasn't tax planning. This was a mechanism to ensure that even if Epstein went down, the women who helped him would be financially secure - and therefore unlikely to cooperate with prosecutors.


Questions That Remain



1. How much money flowed through the Butterfly Trust?

2. Did the trustees (Indyke/Kahn) make distributions to Kellen, Marcinkova, or Maxwell?

3. Is the trust still active? (It was designed to last 21 years after the death of the last named beneficiary)

4. Did prosecutors know about this trust during the NPA negotiations?

5. Who are Jennifer Kalin, Alina Boiko, and Susan Hamblin?


The Immunity Defense That Worked



Ghislaine Maxwell's defense attorneys argued she was protected by the NPA's co-conspirator immunity clause. From EFTA00028886:


> "Ms. Maxwell thus need not show that the parties to the NPA were thinking of her 'in particular'; rather, it is sufficient that she falls within the class of individuals the parties to the NPA intended to benefit."


Maxwell was convicted anyway - but only because Epstein died, arguably mooting the agreement.


Sarah Kellen was named in the NPA but never charged federally. She now goes by Sarah Kensington and reportedly lives in luxury.


Nadia Marcinkova was also protected. She became a pilot and changed her name to Nadia Marcinko.


The Butterfly Trust ensured they would be taken care of financially. The NPA ensured they would never be prosecuted.


Conclusion



The Butterfly Trust is perhaps the clearest evidence that Epstein's operation was not the work of one man. It was a system - with legal structures, financial mechanisms, and participants who were contractually bound to each other through offshore trusts.


Jeffrey Epstein didn't just abuse victims. He built an enterprise. And the lawyers who helped him build it are still practicing law today.
