# The Prosecution Memo They Never Wanted You to See


The DOJ released millions of Epstein documents. We found one that shows exactly who federal prosecutors wanted to charge - and why some got away.




What Is This Document?



On December 19, 2019, federal prosecutors wrote a memo to their boss, Geoffrey Berman. He was the U.S. Attorney for the Southern District of New York.


The memo was about who else should be charged in the Epstein case. The document number is EFTA02731082.


What The Memo Says



The memo has a clear subject line: *Investigation into Potential Co-Conspirators of Jeffrey Epstein*.


It names two people directly:

- **Ghislaine Maxwell**

- **Lesley Groff**


Other names are blacked out. But we can see there are more.


The prosecutors wrote: *"This memorandum details the investigative steps taken since the indictment of Jeffrey Epstein in this District on July 2, 2019 and analyzes the extent to which certain of Epstein's associates and employees may or may not be criminally liable."*


The Scheduling Pattern



The memo shows how the operation worked.


Lesley Groff scheduled victim appointments. She was Epstein's assistant. Multiple victims told investigators they told the schedulers their ages.


Phone records proved the coordination.


The memo says victims described "telling schedulers their ages" when setting up their visits to Epstein.


Why This Matters



Jeffrey Epstein died on August 10, 2019 - less than two months after his arrest.


This memo was written four months after his death. Prosecutors were still building cases against his helpers.


Ghislaine Maxwell was eventually arrested and convicted. She is now in prison.


But Lesley Groff never faced charges. She was named as a "potential co-conspirator" in Epstein's original deal back in 2007. That deal gave her immunity - but only in Florida.


The prosecutors in New York could have charged her. This memo shows they were thinking about it.


The 2007 Deal



In 2007, Epstein made a deal with prosecutors in Florida. That deal protected his helpers from being charged.


A federal judge later called this deal "unusual" and said it showed "poor judgment" by the prosecutors.


The judge said the deal only covered crimes from 2001 to 2007. It only applied in Florida - not in New York.


So why didn't New York charge more people?


The memo we found was written to help answer that question. But most of the analysis is blacked out.
